Subscription Agreement
By clicking "Buy Now" or using the eTextbook Services, you are entering into this Subscription Agreement, which is a binding contract with 蜜桃app Education, Inc. for the benefit of itself and its affiliates (collectively, 鈥渨e,鈥� 鈥渦s,鈥� or "蜜桃app")
You are subscribing to one or more products or services offered on the 蜜桃app+ platform (otherwise referred to as 鈥�蜜桃app+ Services,鈥� 鈥渙ur Services,鈥� or 鈥渢he Services鈥�), which allows you, during the term of your subscription, to access certain educational or other content (鈥�蜜桃app+ Content鈥�) on certain Internet-connected mobile devices, desktop computers, and other supported devices (鈥�Supported Devices鈥�). 蜜桃app+ Content may include various products and the subscription terms for these products may vary. This Subscription Agreement provides details on any product-specific terms to the extent the terms vary for a specific product offered through the 蜜桃app+ Services.
This Subscription Agreement incorporates by reference 蜜桃app鈥檚 (鈥淯TOS鈥�), and your use of the 蜜桃app+ Services is subject to the terms set forth therein. We鈥檝e tried to ensure that the terms of this Subscription Agreement and the UTOS are consistent, but if there is any conflict between them relating to your use of the 蜜桃app+ Services, the terms of this Subscription Agreement will prevail.
The section headings and italicized summaries contained below are for your convenience only, and do not have any legal meaning or effect.
1. Data Privacy, Collection, & Use
蜜桃app's data collection and use practices for the 蜜桃app+ Services are explained in the 蜜桃app+ Privacy Notice. We will collect, process, and use your personal information in accordance with this policy.
2. Your Subscription
Details regarding your subscription term and status may be viewed and managed in your account settings. To use the 蜜桃app+ Services you must have Internet access and a Supported聽Device and provide us with one or more Payment Methods as described in the 鈥淧ayment, Billing, & Price Changes鈥� Section below.
2.1. eTextbook Subscriptions
Unless you have purchased Lifetime Access to your Textbook, your eTextbook subscription will end after your initial six-month subscription period unless you turn on auto-renew in your account settings. 聽If you turn on auto-renew, beginning at the end of your initial subscription period, and until you turn off auto-renew again, your Subscription will automatically renew each month and your Payment Method will be charged the monthly fee shown in your account settings.
Subscription Access.聽 Your eTextbook subscription begins on the date you pay to access the 蜜桃app+ Services and will continue for an initial subscription period of six (6) months.聽 You may either make a single upfront payment for the initial subscription period at the time of purchase or, at your election, you may make six (6) equal monthly payments for the initial subscription period.聽 You will be prompted at the point of purchase to make your decision.
If you turn on auto-renew in your account settings, your subscription will continue beyond your initial six-month subscription period and automatically renew and, until you turn off auto-renew in your account settings, your Payment Method will be charged on a month-to-month basis for additional one-month subscription periods at the monthly fee shown in your account settings. Lifetime Access. 聽鈥淟ifetime Access鈥� is a one-time purchase of an eTextbook in 蜜桃app+ for a set access term of five (5) years. During this five-year access term, you will have full online or web access to your eTextbook, as well as access through our free mobile and desktop apps. After that five-year access term expires, you will no longer have access, whether online or through our mobile and desktop apps, unless you have already downloaded the title before the expiration of the five-year term, in which case you may continue to access your eTextbook, but only through our free mobile and desktop apps. All licenses are non-transferrable. 聽
With 鈥淟ifetime Access,鈥� you may download your eTextbook only during the initial five-year period, and they can only be accessed through our free 蜜桃app+ apps. Device management rules apply.
2.2. Study Prep Subscriptions
Beginning at the end of your initial subscription period, your subscription to Study Prep will automatically renew for the period set forth in the chart below and your Payment Method will be charged the fee set forth in the chart below, until you turn off auto-renew.

Your Study Prep subscription begins on the date you pay to access the 蜜桃app+ Services and will continue for the initial subscription period you have purchased (which can be found in your account settings). Please note: 聽the Fee Schedule is subject to change and may not reflect the price you paid at the time of purchase. 聽 If you have a current 蜜桃app+ subscription, the fee that will apply to your next renewal can be accessed via your account settings.
FOLLOWING THIS INITIAL SUBSCRIPTION PERIOD, YOUR SUBSCRIPTION WILL CONTINUE AND AUTOMATICALLY RENEW AND YOUR PAYMENT METHOD WILL BE CHARGED FOR THE APPLICABLE RENEWAL SUBSCRIPTION TERM YOU HAVE PURCHASED (AS SHOWN IN THE CHART ABOVE) UNTIL YOU TURN OFF AUTO-RENEW IN YOUR ACCOUNT SETTINGS.聽聽聽
Details regarding your subscription term and status may be viewed and managed in your account settings.聽 Your Payment Method will be billed at the start of your initial subscription period, and upon each renewal of your subscription.
2.3 eTextbook + Study Prep Subscriptions
Unless you have purchased Lifetime Access to your eTextbook, your subscription for eTextbook + Study Prep 聽will end after your initial six-month subscription period unless you turn on auto-renew in your account settings. If you turn on auto-renew, 聽beginning at the end of your initial subscription period, and until you turn off auto-renew again, your subscription will automatically renew each month and your Payment Method will be charged the monthly fee shown in your account settings

Lifetime Access.聽 鈥淟ifetime Access鈥� is a one-time purchase of an eTextbook in 蜜桃app+ for a set access term of five (5) years. 2.4 MyLab/Mastering + Study Prep Subscriptions
Your MyLab/Mastering + Study Prep (鈥淢LM Pack鈥�) includes two products: 聽access to MyLab/Mastering, and a subscription to Study Prep. 聽Your access to the MyLab/Mastering portion of this MLM Pack will end after your purchased access period. Your subscription for Study Prep will automatically renew each month and your Payment Method will be charged the monthly fee shown in your account settings until you turn off auto-renew in your account settings.
You will have two charges at the time you purchase your MLM Pack: one upfront payment for the entire access period for your MyLab/Mastering, and the other for the first month of your Study Prep subscription.
Your MyLab/Mastering access begins on the date your Payment Method is charged for the single upfront payment for the entire access period. The length of this period will be stated at the point of purchase and in the order confirmation email.聽
Your Study Prep subscription begins on the date your Payment Method is charged for your first monthly fee. After that, your Study Prep subscription will automatically renew monthly and, until you turn off auto-renew in your account settings, your Payment Method will be charged on a month-to-month basis for additional one-month subscription periods at the monthly fee shown in your account settings. Details regarding your Study Prep subscription may be viewed and managed in your account settings.
3. Promotional Offers
We may, but are not required to, offer you special deals or promotions for 蜜桃app or third-party products or services.
Through the 蜜桃app+ Services, we may from time to time provide you with promotional offers, plans, or subscriptions for additional products or services from 蜜桃app or third parties. Eligibility for 蜜桃app-provided offers is determined solely by 蜜桃app, and we reserve the right to revoke offers and/or product or service access if we determine you are not eligible. In the event that a 蜜桃app-provided offer mistakenly lists an incorrect price or offer term, 蜜桃app reserves the right to refuse or cancel any orders placed for the offered product or service, whether or not the order has been confirmed and whether or not you have been charged for such offer, product, or service.聽
Eligibility for, and the terms and conditions governing, third-party offers and product or service access are determined solely by the third-party. 蜜桃app is not responsible for any aspect of such third-party offers, or the delivery, quality, or satisfaction of any related third-party products or services.
4. Payment, Billing, & Price Changes
You can pay with your credit card, Apple Pay or PayPal account.聽 We reserve the right to change our plans or pricing at any time.
Payment Methods. You may pay for your subscription using: (1) a valid Visa, MasterCard, American Express, Discover, or JCB credit card or debit card; (2) Apple Pay; or (3) PayPal (each a 鈥�Payment Method鈥�). You agree that your selected Payment Method may be charged by 蜜桃app when you subscribe. You agree to pay all amounts due at the time you place your order. All amounts are non-refundable unless otherwise noted below. Confirmation of your order will be sent to the email address on file for your account. You are responsible for all taxes and tariffs. 蜜桃app will collect and report state and local taxes applicable to your billing address and charge such taxes to your Payment Method. If 蜜桃app is unable to successfully charge your Payment Method for the full amount owed, you agree that 蜜桃app may pursue all available lawful remedies in order to obtain payment.
Updating your Payment Methods. You may update your Payment Methods in your account settings. We may also update your Payment Methods using information provided by Apple Pay, or PayPal. Following any update, you authorize us to continue to charge the applicable Payment Method(s).
Billing Cycle. Subscription fees, and any other charges you may incur in connection with your use of the 蜜桃app+ Services, such as taxes and possible transaction fees, will be charged to your Payment Method upon purchase.聽聽
a. eTextbook. At the initial purchase of an eTextbook subscription, you will have an option to make a single upfront payment or six (6) equal monthly payments for the initial subscription term.聽 If you elect to pay for your initial eTextbook subscription in monthly installments, or if you elect auto-renewal on your account, your Payment Method will be charged each month your subscription is active. If you elect to make a single upfront payment for your initial eTextbook subscription, you will only be charged once at the start of your subscription, unless you turn on auto-renewal in your account, in which case your Payment Method will be charged each month your subscription is active following the completion of the initial term.
b. Study Prep. Your Payment Method will be billed at the start of your initial subscription period for your Study Prep subscription, and at the start of the relevant renewal period upon each renewal thereafter.
c. eTextbook + Study Prep. At the initial purchase of an eTextbook + Study Prep subscription, you will have an option to make a single upfront payment or six (6) equal monthly payments for the initial subscription term. 聽If you elect to pay for your initial eTextbook + Study Prep subscription in monthly installments, or if you elect auto-renewal on your account, your Payment Method will be charged each month your subscription is active. If you elect to make a single upfront payment for your initial eTextbook + Study Prep subscription, you will only be charged once at the start of your subscription, unless you turn on auto-renewal in your account, in which case your Payment Method will be charged each month your subscription is active following the completion of the initial term.
d. MyLab/Mastering + Study Prep (MLM Pack).聽Your Payment Method will be billed for two charges at the initial purchase of your MLM Pack subscription: 聽one upfront payment for the entire access period for your MyLab/Mastering, and the other for the first month of your Study Prep subscription. 聽After that, your Payment Method will be charged each month your Study Prep subscription is active.
Subscription fees are fully earned by us upon payment. Failure by you to use any 蜜桃app+ Services does not relieve you of your payment obligations under this Subscription Agreement, nor does it entitle you to any refund except as provided in Section 5 below.聽 We may authorize your Payment Method in anticipation of subscription-related charges through various methods, including authorizing it for the total amount due for the initial subscription period for your eTextbook subscription as soon as you subscribe, even if you have elected to pay for your eTextbook subscription in monthly installments. If your payment fails for any reason, your subscription may be temporarily suspended for you to correct the issue. If the issue is not corrected, your subscription may be suspended indefinitely or terminated.
Changes to the Price and Subscription Plans.聽We reserve the right to change our subscription plans or adjust pricing for the 蜜桃app+ Service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Except as otherwise expressly provided for in this Subscription Agreement, if you have auto-renew turned on for your eTextbook, your eTextbook + Study Prep or your MLM Pack subscription, any price changes or changes to your subscription plan will take effect at the end of your initial subscription period or at the start of the next billing cycle, whichever is later, but in either case following notice to you. 聽Any price changes or changes to your subscription plan relating to your Study Prep subscription (whether purchased standalone or as part of a MLM Pack) will take effect at the next renewal following notice to you.
5. Cancellation, Refunds, & Credits
You may cancel your eTextbook subscription for a full refund within your Refund Period, and (if you鈥檝e turned it on) you can turn your subscription鈥檚 auto-renewal off at any time prior to 11:59 p.m. Eastern Time, on the last day of your current subscription period to opt out of future auto-renewal. 聽蜜桃app+ Study Prep 聽subscriptions are nonrefundable.
Cancellation and Refund.聽Once purchased, 蜜桃app will not provide a refund or credit for a Study Prep 聽subscription. 聽You may cancel your eTextbook, eTextbook + Study Prep, or MLM Pack subscription and request a full refund during the refund period described at your time of purchase (鈥�Refund Period鈥�) by going to your account, or contacting聽蜜桃app Support. If you cancel your eTextbook subscription and request a refund during the Refund Period, your eTextbook subscription will end immediately. After your Refund Period, your eTextbook subscription fee is nonrefundable. Except as provided in this Section 5, 蜜桃app will not provide a refund or credit for partially used subscriptions.
Auto-renewal.聽Your Study Prep subscription (whether purchased standalone or as part of a MLM Pack) is an auto-renewing subscription, and you can convert your eTextbook subscription to an auto-renewing subscription by turning on auto-renewal in your account settings. You can prevent your auto-renewing subscription (whether for eTextbook or Study Prep) from auto-renewing by turning off auto-renewal in your account settings no later than 11:59 p.m. Eastern Time on the last day of your current subscription period. If you do, your access to the relevant 蜜桃app+ Services will continue through the end of your current subscription period, at which time your access will end.
Credits.聽At any time, and for any reason at our sole discretion, we may provide a refund, discount, or other consideration to some or all of our customers that is outside the policies set forth above in this Section 5. The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of any such credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide any such credits in the future, under any circumstance.
6. Service, Device, & Content Limitations
Your subscription to use and enjoy 蜜桃app+ comes with some limitations.
As set forth in the UTOS, your use of the 蜜桃app+ Services is subject to 蜜桃app鈥檚鈥��(鈥�AUP鈥�).聽By accessing or using the Services you agree to comply with the terms of the AUP. As described on the 蜜桃app+ website, device and/or download limitations may also apply. The number and type of Supported Devices that may be used to access the 蜜桃app+ Services is limited, as are the number of downloads of 蜜桃app+ Content for offline consumption as shown in the chart below:

蜜桃app reserves the right to change its Supported Device and download policies at any time. Notice of such changes will be posted on the 蜜桃app+ website. Additionally, 蜜桃app+ Content is regularly updated. We may add or remove content from the 蜜桃app+ Services in our sole discretion. 聽
If 蜜桃app discontinues a Service to which affects your ability to access your eTextbook Lifetime Access, 聽蜜桃app, in its sole discretion may: (1) replace such Service with a substantially similar service or (2) provide you with a reasonable substitution of another 蜜桃app product or service.
蜜桃app reserves the right, at its sole discretion, to suspend or terminate access to and use of the Services, or to take any other available legal action, with respect to any user that 蜜桃app reasonably believes has undertaken, or participated in, any activities that violate the terms of this Section, including the AUP, or whose actions have, or are likely to, otherwise cause harm to 蜜桃app, the 蜜桃app+ Services, or the Services or Service Network as defined in the AUP, or other users, or for any other reason at the sole and absolute discretion of 蜜桃app.
7.聽Governing Law and Venue
You agree that this Agreement will be governed by and construed subject to the laws of the State of New York, without giving effect to its conflict of law principles, and that exclusive jurisdiction and venue over any disputes arising under this Agreement will be in the State or Federal courts in New York, NY. 聽YOU HEREBY WAIVE ANY OBJECTION TO THIS VENUE AS INCONVENIENT OR INAPPROPRIATE.聽
8. Customer Support
To find more information about the 蜜桃app+ Service and its features, or if you need assistance with your account, please visit聽蜜桃app Support.聽In the event of any conflict between this Subscription Agreement and information provided by Customer Service or other portions of 蜜桃app鈥檚 websites, this Subscription Agreement will control.
9. Changes to Subscription Agreement
We may occasionally need to update the rules in this Subscription Agreement. But if we make meaningful changes, we鈥檒l let you know. By continuing to use 蜜桃app+, you agree to follow the updated rules.
蜜桃app may make changes to this Subscription Agreement from time to time for any reason. Typically, these changes are made to conform to current practices, to comply with changing regulatory requirements, or for other similar purposes. If 蜜桃app modifies this Subscription Agreement in a manner that materially changes the terms or scope of the Services made available to you (鈥�Service Change鈥�), we will make reasonable efforts to notify you by either contacting you via email or posting reasonable notice in connection with the Services to alert you to such changes. Your continued use of the Services after reasonable notice of such changes to this Subscription Agreement has been provided will constitute your consent to the revised Subscription Agreement terms, which shall apply to any use of the Services following reasonable notice. If you deem any Service Change to have a material impact on you, you: (1) must so notify 蜜桃app at聽蜜桃app Support聽within thirty days after receiving notice of such change; and (2) may terminate your subscription and your use of the Services, however the cancellation, refund and credit provisions of Section 5 shall still apply.
